2. Eligibility

You must be at least the age required by the laws of your country or region to use the Service.

If you are under the age of legal majority where you live, you may use the Service only with permission of your parent or legal guardian.

3. Your Account

You may need to create an account to access certain features.

You agree to:

• provide accurate and current account information;
• keep your login credentials secure;
• be responsible for activity under your account;
• notify us promptly if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms, harm the Service, or create safety, legal, or operational risk.

4. Limited License

Subject to these Terms, MEKASMITH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes.

You may not:

• copy, modify, distribute, sell, lease, or commercially exploit the Service except as expressly authorized;
• reverse engineer, decompile, or attempt to extract source code except where prohibited by law from restricting such activity;
• interfere with the Service, servers, security, or other users.

5. User-Generated Content

Wonders of Aether may allow users to create, upload, share, or publish content, including worlds, assets, text, comments, images, designs, gameplay elements, or other materials ("User Content").

You are solely responsible for the User Content you submit.

You must have all rights necessary to submit your User Content and to grant the rights described in these Terms.

6. Prohibited Conduct

You may not use the Service to create, upload, post, transmit, or distribute content or engage in conduct that:

• is illegal, unlawful, fraudulent, or deceptive;
• infringes intellectual property or other rights;
• contains malware, exploits, or harmful code;
• threatens violence or promotes terrorism or criminal conduct;
• exploits, harms, or sexualizes minors in any way;
• is pornographic, excessively sexual, or otherwise inappropriate for the Service;
• harasses, bullies, stalks, doxes, or abuses others;
• impersonates another person or entity;
• invades privacy or discloses personal information without authorization;
• promotes hate, discrimination, or unlawful harassment;
• attempts to cheat, exploit, bot, manipulate, or disrupt gameplay or systems.

7. Moderation, Reporting, and Enforcement

We may monitor, review, restrict, remove, disable access to, or refuse User Content or accounts when we reasonably believe it violates these Terms, our policies, platform rules, applicable law, or community safety standards.

Users may report illegal, unlawful, infringing, abusive, or otherwise prohibited content by contacting: report@wondersofaether.com

Where available, users should also use in-app or in-game reporting tools.

We may take actions including warnings, content removal, temporary suspension, permanent bans, and referral to law enforcement where appropriate.

8. User Content License

You retain ownership of your User Content, subject to the rights you grant to us.

By submitting User Content to the Service, you grant MEKASMITH a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify only as technically necessary, display, perform, distribute, publish, moderate, and otherwise use that User Content solely for the purposes of:

• operating and providing the Service;
• making User Content available within the Service;
• maintaining safety and moderation systems;
• improving, promoting, and supporting the Service.

This license ends within a commercially reasonable time after the User Content is permanently removed from the Service, except to the extent retention is necessary for backups, legal obligations, dispute resolution, fraud prevention, or enforcement purposes.

9. Intellectual Property

The Service, including its software, systems, branding, artwork, game design, logos, text, graphics, audiovisual materials, and underlying technology, is owned by or licensed to MEKASMITH and is protected by intellectual property laws.

Except for the limited license granted above, no rights are transferred to you.

10. Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation.

11. Account Deletion

You may request deletion of your account through:

• the Taverns Mobile app, where available; or
• support@wondersofaether.com; or
• our web deletion page at https://wondersofaether.com/privacy#account-deletion

Deletion may be subject to verification, security checks, and lawful retention requirements.

12. Privacy

Your use of the Service is also subject to our Privacy Policy.

13. Third-Party Platforms and Services

The Service may be distributed through or interact with third-party platforms, app stores, hosting providers, payment processors, or related services. Those third parties may have their own rules and terms that apply to your use of their services.

14. Service Availability

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or secure.

15. Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

16. Limitation of Liability

To the maximum extent permitted by law, MEKASMITH and its directors, officers, employees, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability arising out of or related to the Service will not exceed the greater of:

• the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim; or
• JPY 10,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

17. Indemnity

You agree to indemnify and hold harmless MEKASMITH and its affiliates, officers, employees, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• your User Content;
• your misuse of the Service;
• your violation of these Terms;
• your violation of law or the rights of another person.

18. Termination

We may suspend or terminate your access to the Service at any time if:

• you violate these Terms;
• your use creates legal, security, or operational risk;
• we are required to do so by law or platform policy.

Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, liability limits, indemnity, governing law, and disputes.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles.

Unless otherwise required by applicable law, the Tokyo District Court shall have exclusive jurisdiction in the first instance for disputes arising out of or relating to these Terms or the Service.

20. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms.
